TEAMChallenge GmbH, owned by Ms. Alice Walchshöfer, Westring 40, 91154 Roth, shall be your contractual partner for all orders placed with the Challenge Fan Shop. The contract shall be concluded in German language. All information on products and prices is subject to change without notice and non-binding. When placing an order you submit a binding quote. The quote will be accepted by delivery of the products or by written confirmation of the order.We shall only accept orders from customers who have reached the age of eighteen.
2. How to place an order
You can place an order online at www.challenge-shop.de (24 hours a day, 7 days a week) by clicking on the desired products on the website and putting them in a virtual shopping cart. At the end of your purchase, all the products you have chosen will be displayed on a list, which will also include the total price as well as forwarding expenses. Before you send the order you will have the opportunity to check whether the indicated information is correct, in particular the billing and delivery address, the price as well as the number of ordered articles, and can amend your order if necessary. The receipt of your order will immediately be acknowledged via e-mail.
3. Right of return
Customers of the Challenge Fan Shop shall have the right to return delivered products within 14 days without giving any reasons. The purchase contract/credit purchase contract shall enter into effect upon receipt of the products by way of acceptance, at the latest after expiry of the 14-day deadline for returning the products.
4. Information on withdrawal
4.1 Right of withdrawal
You may withdraw your contractual declaration within two weeks after expiry of the 14-day return deadline indicated in item 3. without giving any reasons, but in written form, e. g. via letter, fax or e-mail, or by returning the products.
At the earliest, the withdrawal deadline shall start upon receipt of the products and the present information, but not before expiry of the return deadline indicated in item 3. In order to meet the withdrawal deadline the timely mailing of the withdrawal or of the products shall be sufficient. The withdrawal or the products you wish to return are to be sent to: TEAMChallenge GmbH, Westring 40, 91154 Roth.
4.2 Consequences of withdrawal
In case of a valid withdrawal the goods or payments received by the parties are to be returned and possible benefits derived therefrom (e. g. advantages of use) are to be compensated for. If you cannot return the delivered products to us at all, or if you can only return them in part, or if the returned goods are in a deteriorated condition, you will possibly have to compensate us therefor. No compensation shall be due if the deterioration of the goods is exclusively due to ordinary perusal of the goods – as would have been the case in a bricks-and-mortar shop. You can avoid having to pay compensation by not using the products like your own property and refraining from usage that might influence the value of the products.
Attention:
Products that can be dispatched by post are to be returned. You will have to bear the costs for returning the goods if the delivered products correspond to the ones you ordered and if the price of the returned products does not exceed an amount of 40 €, or, in case of a higher price, if you have not yet effected the payment or a partial payment agreed upon at the time of your withdrawal.
5. Warranty period
If any of the delivered products should have obvious faults in the material or manufacturing flaws, which also includes damage caused during transport, please complain immediately with us or the postal service that has delivered the products. However, if you do not make such complaint immediately, this will not affect your right to assert corresponding claims. For all deficiencies of the article that occur within the statutory warranty period, you may either claim supplementary performance, repair of deficiencies/new delivery or – if the legal prerequisites are met – abatement or withdrawal as well as compensation, including compensation of the damage instead of performance as well as compensation for your expenditures made in vain. As far as we grant a vendor warranty, the details are apparent from the warranty conditions enclosed to the delivered article. Warranty claims exist without prejudice to statutory claims/rights.
6. Undeliverable articles
Should a specific article be undeliverable, we undertake to inform you about this fact before accepting your order. In such cases, we reserve the right to send you a substitute whose price and quality are equivalent to the ordered article. If you do not want to accept or keep the substitute, you may return it to us free of charge within the statutory warranty period.
7. Validity of prices
Validity of prices: The prices stated on the website include VAT and shall be valid until December 31, 2008.
8. Costs for returning or collecting goods
Costs for returning or collecting goods: The costs for returning goods by mail or forwarding agent or for having them collected corresponds to the costs incurred in delivering the goods to the customer, as long as the same postal or forwarding service is used.
9. Payment
Payment: The payment of the products can be effected by transfer, check or credit card (Mastercard & Visacard). A cash discount is not allowed.
In special cases we reserve the right not to deliver the goods before we have received a down payment. We will inform the customer accordingly well in advance and discuss the details of such down payment. If your payment is delayed, TEAMChallenge GmbH reserves the right to bill you for the reminder charges, which amount to € 2.75 for the first reminder and € 3.50 for the second reminder.
10. Reservation of proprietary rights
We shall remain the owners of delivered goods until they have been paid for in full.
